Nothing in this policy excludes or restricts any statutory rights or remedies that cannot lawfully be excluded under applicable law.

Programme-specific assessment rules, including pass marks, examination attempts, reassessment arrangements and permitted resources, take precedence where expressly communicated.
Certificates are issued to eligible learners who successfully fulfil the applicable programme requirements.
Depending on the course, these may include completion of learning activities, passing assessments, submitting assignments or satisfying other academic and administrative conditions.
Certificates may be issued by IIEA or, where expressly indicated, by an external educational or professional institution.
A certificate of completion does not automatically constitute a professional licence, regulated qualification, academic degree or authorisation to practise in a regulated profession.
Recognition, professional membership, credit transfer and eligibility for external designations are governed by the requirements of the relevant institution or professional body.
IIEA does not guarantee employment, promotion, professional registration or acceptance of credentials by third parties.
Some programmes may be offered through collaborations with external education providers, awarding institutions or professional bodies.

However, uninterrupted or error-free access cannot be guaranteed due to scheduled maintenance, technical faults, internet connectivity issues or circumstances beyond reasonable control.
Learners are responsible for maintaining suitable devices, internet access and compatible software necessary to participate in their courses.
IIEA will make reasonable efforts to resolve platform disruptions and communicate material service interruptions affecting enrolled learners.
IIEA processes personal information in accordance with its Privacy Policy and applicable data protection laws, including the Kenya Data Protection Act, 2019.
Personal information may be processed for purposes including:
Account creation and learner administration.
Course enrolment and access management.
Payment processing and recordkeeping.
Assessment administration and certification.
Learner support and service improvement.
Compliance with applicable legal and regulatory obligations.
Where applicable, learner information may be shared with authorised educational partners or service providers for legitimate programme administration and certification purposes, subject to appropriate data protection safeguards.
Please refer to our Privacy Policy for further information about personal data processing and individual rights.
Organisations enrolling employees or other participants may be subject to separate corporate training agreements, institutional arrangements or enterprise learning terms.
Such agreements may address enrolment administration, learner access, reporting, fees, confidentiality and other applicable requirements.
Where a separately executed agreement expressly conflicts with these Terms of Service, the relevant provisions of that agreement will govern the services covered by it.
IIEA may introduce, update, replace or discontinue courses and platform features in response to academic developments, regulatory changes, operational requirements or learner needs.
For learners already enrolled, IIEA will take reasonable steps to avoid unfair disruption and, where appropriate, provide alternative arrangements or remedies consistent with applicable law.
IIEA makes reasonable efforts to ensure that course materials are accurate, relevant and professionally developed.
However, educational content is provided for learning and professional development purposes and should not automatically be treated as legal, financial, regulatory or other professional advice applicable to a particular situation.
To the extent permitted by law, IIEA is not liable for indirect or consequential losses arising from use of the platform.
Nothing in these terms excludes or restricts liability that cannot lawfully be excluded or limits mandatory consumer protection rights.
IIEA may suspend or terminate access where a user materially breaches these Terms of Service, engages in academic misconduct or threatens the security or integrity of the platform.
Where reasonably practicable, users will be informed of the grounds for such action and given an opportunity to respond or remedy the breach.
Termination does not automatically extinguish accrued payment obligations, intellectual property protections or other provisions intended to survive termination.
Any refund or remedy arising from termination will be determined in accordance with applicable law and the relevant programme conditions.
IIEA may update these Terms of Service to reflect changes in legal requirements, platform functionality, educational services or institutional policies.
The revised terms will be published on the website with an updated effective date.
Where changes materially affect existing users, IIEA will provide appropriate notice. Material changes will not retrospectively remove accrued rights or alter confirmed contractual commitments without a lawful basis.
These Terms of Service are governed by the laws of the Republic of Kenya.
Users are encouraged to raise complaints or disputes with IIEA in the first instance so that reasonable efforts can be made to resolve matters amicably.
Where a dispute cannot be resolved through the internal complaints process, the parties may pursue available legal remedies before the competent courts or other appropriate dispute resolution bodies, subject to applicable law.
Nothing in this clause removes mandatory rights or remedies available to consumers under applicable law.
